Preamble — Scope of Application

These Terms of Service apply to all services and products offered by StreamExp, accessible via streamexp-app.com and its subdomains.

• These Terms cover all services on the site: quests, shop, virtual currencies, referrals, merchant space, chat, and any future service.
• Any purchase of a paid product or service constitutes express acceptance of these Terms.
• The applicable version of the Terms is the one online at the time of service use.
• In the event of a conflict between the Terms and specific conditions for a service, the specific conditions shall prevail.

1. Purpose

These Terms of Service govern the use of the StreamExp platform, accessible at StreamExp-app.com. StreamExp is a gamification service for the Twitch platform.

2. Acceptance of Terms

Using StreamExp implies full and complete acceptance of these Terms of Service.

3. Description of the Service

• A quest system linked to Twitch interactions (watching, chat, subscribe)
• A reward system (credits, ores, tokens)
• A shop for purchasing tokens and consumables
• A referral system
• A Merchant space for subscribed streamers
• Moderation tools for streamers
• For certain quests (especially Chat quests), StreamExp reads Twitch chat messages in real time to verify participation. Messages are temporarily retained for anti-cheat verification purposes (50 messages maximum per user) and automatically deleted beyond this threshold.

4. Registration and Account

Registration is done exclusively via Twitch authentication (OAuth). By registering, you authorize StreamExp to access basic information from your Twitch account.

5. Virtual Currencies and Purchases

StreamExp uses several virtual currencies: Credits, Gold, Diamonds, and Tokens.

• Tokens can be purchased with real money via Stripe. Other currencies (Credits, Gold, Diamonds) are earned solely through service usage (quests, rewards).
• Virtual currencies have no real monetary value and do not constitute a currency, asset, or financial instrument.
• Virtual currencies are non-transferable between users and cannot be exchanged for real money.
• Non-purchased virtual currencies (Credits, Gold, Diamonds) are non-refundable.
• StreamExp reserves the right to modify rates, rewards, and the virtual economy at any time without compensation.
• In the event of account deletion or ban, non-purchased virtual currencies are forfeited without compensation.
• Credits may be exchanged for partner rewards (discounts, promotional codes, etc.) subject to availability and stock. StreamExp does not guarantee the quality, availability, or delivery of products or services offered by partners. The partner rewards catalogue may be changed at any time.

6. Order Process and Delivery

In accordance with Article L221-5 of the French Consumer Code, the Token ordering process on StreamExp follows these steps:

• Selection: the user selects the desired Token pack in the shop.
• Summary: an order summary (quantity, price including tax) is displayed before validation.
• Correction: the user can review and correct order details before proceeding to payment.
• Payment: payment is processed via Stripe. The order is only finalized upon payment confirmation.
• Confirmation: a purchase summary is displayed. A confirmation email may be sent.
• Delivery: Tokens are digital goods delivered immediately. They are credited to the user's account upon payment confirmation.

7. User Conduct

• Cheating or manipulating the quest system
• Using unauthorized bots, scripts, or automation
• Creating multiple accounts to exploit the system
• Harassing, threatening, or intimidating other users
• Spamming chat or communication systems
• Impersonating another user
• Attempting to hack, decompile, or modify the service

8. Sanctions

• Warning
• Quest invalidation
• Temporary account restriction
• Permanent ban

9. Payments and Refunds

Payments are processed by Stripe. All prices are displayed in euros, including all applicable taxes.

• Every Token purchase is confirmed by a summary before payment. A confirmation email is sent after each purchase.
• Purchased Tokens are delivered immediately in digital form and credited to your account.
• In accordance with Article L221-18 of the French Consumer Code, you have a 14-day right of withdrawal from the date of purchase.
• However, in accordance with Article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for digital content provided on an intangible medium whose execution has begun with your express consent and your express waiver of your right of withdrawal. Therefore, any Token that has been used (spent in the shop) is no longer refundable.
• To exercise your right of withdrawal for unused Tokens, send an email to contact@StreamExp.gg specifying your username, the purchase date, and the amount concerned. Refunds will be processed within 14 days via the same payment method.

10. Promotional Offers

StreamExp may offer promotional deals, discount codes, or special events.

• The specific conditions of each offer (duration, eligibility, benefits) are communicated at the time of launch.
• Unless otherwise stated, promotional offers cannot be combined with each other.
• StreamExp reserves the right to modify or cancel a promotional offer in the event of abuse, technical error, or fraud.
• Benefits obtained during a promotion remain subject to these Terms and the platform Rules.

11. Intellectual Property

StreamExp and all its content are protected by intellectual property law. The 'Twitch' trademark and its logos are the property of Twitch Interactive, Inc.

12. Limitation of Liability

StreamExp is provided "as is" and "as available". We do not guarantee uninterrupted operation of the service.

• StreamExp shall not be held liable for service interruptions, whether due to maintenance operations, updates, technical failures, or events beyond our control.
• StreamExp shall not be held liable for loss of quest progress, non-purchased virtual currencies, or data related to service usage, except in the case of intentional fault on our part.
• In any event, StreamExp's total liability to a user, for all causes combined, is limited to the total amount of payments made by that user during the preceding 12 months.
• StreamExp shall not be held liable for modifications, suspensions, or discontinuations of the Twitch API or any third-party service on which the platform depends.

13. Data Protection

The processing of personal data is detailed in our Privacy Policy. The following provisions apply to data collected by the service:

• Global chat: messages sent in the StreamExp global chat are retained for 24 hours and then automatically and permanently deleted (daily purge). No archiving of messages is performed beyond this period.
• Twitch integration bot: as described in Article 3, the StreamExp bot collects in real time the events necessary for quest validation (follows, subscriptions, chat messages). This data is not stored beyond the validation of the relevant quest.
• Streamer consent: integrating the bot on a Twitch channel requires the explicit consent of the streamer, collected via the authorization modal during activation. This consent may be revoked at any time from the Dashboard Settings page, under the 'StreamExp Bot Integration' section, using the 'Disable Bot' button. Revocation immediately disconnects the bot and stops all data collection on the channel in question.
• Account data: StreamExp collects basic Twitch account information via OAuth (username, identifier, avatar). This data is retained as long as your account is active and deleted upon termination.

14. Force Majeure

In accordance with Article 1218 of the French Civil Code, neither party shall be held liable for failure to perform its obligations if such failure is due to a force majeure event, meaning an event beyond the control of the affected party, which could not reasonably have been foreseen, and whose effects cannot be avoided by appropriate measures.

• Force majeure events include but are not limited to: natural disasters, wars, strikes, Internet network failures, third-party service failures (Twitch, Stripe, hosting provider), governmental or regulatory decisions, cyberattacks.
• In the event of force majeure, the obligations of the affected party are suspended for the duration of the event.

15. Duration and Termination

This agreement is concluded for an indefinite period from the date of the user's registration.

• Users may terminate their account at any time by contacting contact@StreamExp.gg. Account deletion results in the permanent loss of non-purchased virtual currencies (Credits, Gold, Diamonds) and quest progress.
• Unused Tokens at the time of account deletion may be refunded upon request, under the conditions set out in Article 9.
• StreamExp reserves the right to suspend or terminate an account in the event of a violation of these Terms or the Rules, in accordance with the sanctions provided in Article 8.

16. Modification of Terms

We reserve the right to modify these Terms of Service at any time. In the event of a substantial modification, you will be notified via the platform. Continued use of the service after notification constitutes acceptance of the new Terms.

17. Age Requirement

StreamExp is intended for individuals aged 13 and over. Minors under 16 must obtain parental consent.

18. Relationship with Twitch

StreamExp is an independent third-party service. We are not responsible for changes made by Twitch to its API, Twitch account suspensions, or any changes in Twitch's terms of service.

• The quest system offered on StreamExp is a promotion organized exclusively by StreamExp. Twitch Interactive, Inc. does not sponsor, endorse, or bear any responsibility for this quest program or its associated rewards.

19. Severability

If any provision of these Terms of Service is deemed invalid or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.

20. Waiver

StreamExp's failure to exercise any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

21. Entire Agreement

These Terms of Service, together with the Rules, Privacy Policy and Cookie Policy, constitute the entire agreement between you and StreamExp regarding the use of the service.

22. Applicable Law and Disputes

These Terms of Service are governed by French law. In the event of a dispute, an amicable solution shall be sought before any legal action.

In accordance with Articles L612-1 et seq. of the French Consumer Code, you may use a consumer mediator free of charge. The competent mediator will be communicated upon request at contact@StreamExp.gg.
